Mobility Device Repair & Service Plan Agreement 

​

1. Introduction & Scope of Services

When it comes to mobility and accessibility devices, BIONIC AIM LLC ("BionicAIM," "we," "us," or "our") provides professional repair and technical support services for wheelchair-accessible vehicles, residential accessibility equipment, and related mobility devices.

IMPORTANT DISCLAIMER: Services provided under this Plan are not medical services, and the Covered Equipment is not a medical device as defined by federal or California law. BIONIC AIM LLC does not provide medical advice, diagnosis, or treatment.

This Repair & Service Plan (the "Plan") provides repair services and technical support during the coverage period, subject to the terms, exclusions, and limitations set forth herein.

2. Plan Term & Automatic Renewal Disclosure 
  • This Plan is offered as a twelve (12) month service contract, billed on a monthly recurring basis.

  • Coverage begins on the date of purchase and continues for twelve (12) consecutive months unless earlier cancelled.

  • Automatic Renewal Notice: By enrolling, you expressly authorize BIONIC AIM LLC to charge your selected payment method monthly in advance. This Plan automatically renews each month until cancelled by you in accordance with Section 12.

  • You may cancel at any time as described below. Cancellation rights are provided in compliance with California Business & Professions Code §17602.

You acknowledge that the terms of automatic renewal, cancellation methods, and refund limitations have been presented in a clear and conspicuous manner prior to purchase.

3. Relationship to Manufacturer Warranties

Services provided under this Plan are separate from and supplemental to any manufacturer warranty. This Plan does not replace, extend, or modify manufacturer obligations under the Song-Beverly Consumer Warranty Act or any express or implied manufacturer warranty.

4. What Is Covered

4.1 Hardware Coverage

"Hardware" refers solely to the repairable or replaceable mechanical or electrical components of the specific mobility or accessibility equipment identified in your Plan Confirmation.

Coverage applies only to equipment:

  • Owned by you;

  • Located within California;

  • Properly identified at enrollment.

4.2 Technical Support

During the coverage period, you are entitled to reasonable technical support via phone, chat, email, video conferencing, or in-person service (as determined by BionicAIM). Support may include diagnostics, troubleshooting, and repair coordination.

5. What Is Not Covered

5.1 Hardware Exclusions

This Plan does not cover:

(a) Removal, disposal, storage, or loaner/temporary equipment;
(b) Damage resulting from accident, misuse, abuse, negligence, unauthorized modification, improper installation, fire, flood, earthquake, acts of God, or operation outside manufacturer specifications;
(c) Lost or stolen equipment;
(d) Cosmetic or non-functional damage (scratches, dents, cracked housings);
(e) Non-OEM parts or third-party accessories not expressly approved by BionicAIM;
(f) Equipment altered or serviced by unauthorized parties.

 

5.2 Technical Support Exclusions

The Plan does not include:

(a) Training, usage coaching, or user modification support;
(b) Support for third-party devices or software, or compatibility issues;
(c) Electrical, structural, or vehicle systems not part of the covered accessibility equipment.

6. How to Request Service

Service requests may be initiated by:

You consent to reasonable information collection and, where appropriate, video or photo documentation to diagnose service issues.

 

7. Service Methods

BionicAIM may provide service via one or more of the following methods, at its discretion:

(a) Mobile On-Site Service (appointment required)
(b) Drive-In Service at an authorized facility
(c) DIY Parts Shipment (plan-dependent)

BionicAIM reserves the right to determine the appropriate service method based on safety, availability, and manufacturer guidance.

DIY services do not include labor reimbursement, and failure to return required parts may result in charges to your payment method.

 

8. Geographic & Availability Limitations

  • Services are available only within California.

  • No international coverage is provided.

  • Service timelines and part availability are not guaranteed.

 

9. Customer Responsibilities & Indemnification

To remain eligible for coverage, you agree to:

(a) Provide accurate plan and equipment information;
(b) Cooperate with diagnostic and safety requests;
(c) Follow all operating, safety, and service instructions;
(d) Ensure reasonable access to the equipment.

Indemnification: To the fullest extent permitted by law, you agree to indemnify and hold harmless BIONIC AIM LLC, its owners, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising out of or related to misuse of the Covered Equipment, failure to follow instructions, unauthorized modifications, or third-party actions.

 

10. Limitation of Liability & Assumption of Risk 

You acknowledge that mobility and accessibility equipment involves inherent operational and safety risks. To the fullest extent permitted by California law, you voluntarily assume all risks associated with the use, operation, and condition of the Covered Equipment, including after service or repair.

To the maximum extent permitted by law:

  • BIONIC AIM LLC shall not be liable for any incidental, indirect, special, or consequential damages, including loss of use, loss of income, loss of mobility, emotional distress, or loss of data.

  • BIONIC AIM LLC does not assume responsibility for personal injury, property damage, or death arising from improper use, failure to follow instructions, or pre-existing equipment conditions.

  • The total cumulative liability of BIONIC AIM LLC under this Plan shall not exceed the total amount paid by you for the Plan during the preceding twelve (12) months.

Nothing in this Agreement limits liability for gross negligence, willful misconduct, or liability that cannot be limited under California law.

 

11. Disclaimer of Guarantees

BIONIC AIM LLC does not guarantee:

  • That all repairs will restore equipment to "like-new" condition;

  • Continuous or uninterrupted operation;

  • Availability of replacement parts indefinitely.

 

12. Cancellation & Refund Policy 

Customer Cancellation

You may cancel at any time by:

  • Phone notification; or

  • Written notice to:

       support@bionicaim.com

Refunds

  • Within 7 days of enrollment and before any service is rendered: full refund of last payment.

  • After 7 days or after service delivery: no refund; coverage ends on cancellation date.

No cancellation fees apply beyond unpaid balances for services rendered.

13. BionicAIM Cancellation Rights

BionicAIM may cancel this Plan:

  • For fraud or material misrepresentation;

  • If required parts become unavailable (30 days’ written notice);

  • As required by law.

In such cases, unearned prepaid amounts will be refunded on a prorated basis where required by California law.

14. Transferability

This Plan is transferable and applies only to the identified (enrolled) equipment.

15. Dispute Resolution, Arbitration & Governing Law

PLEASE READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS.

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to this Plan, the Covered Equipment, or services provided by BIONIC AIM LLC shall be resolved exclusively by binding arbitrationadministered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration shall take place in Santa Clara County, California.

  • Each party shall bear its own attorney’s fees unless otherwise required by law.

  • CLASS ACTION WAIVER: You agree that any claims will be brought solely in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

If arbitration is found unenforceable under applicable law, disputes shall be resolved exclusively in the state or federal courts located in Santa Clara County, California.

This Agreement is governed by the laws of the State of California, without regard to conflict-of-law principles.

 

16. Privacy & Communications

You consent to:

  • Call recording for quality assurance;

  • Data processing necessary to perform services, consistent with applicable privacy laws.

Personal data will not be sold and will be handled in accordance with California privacy requirements.

17. Entire Agreement

This Agreement, together with your Plan Confirmation and receipt, constitutes the entire agreement between you and BIONIC AIM LLC and supersedes all prior representations.
