Every BionicAIM plan comes with Full hardware Service through the life of your subscription.

Repair coverage will depend on the service plan you selected.

All parts warranty is extended from the time you subscribe until the subscription

is cancelled.

In addition, You could get 24/7 priority access to BIONIC AIM experts by chat or phone or visit.


The plan

ONE year contract plans.


When Coverage Begins and Ends

Coverage begins when you purchase the Plan and ends 12 full months

after your subscription date.


The hardware service and technical support coverage provided

by the Plan is additional to the coverage provided by the manufacturer’s

hardware warranty and complimentary technical support.


All our plans are Monthly Pay Plans, you agree to have the credit card,

debit card or other authorized payment source i.e., Visa (the “Payment Source”)

used for your Plan purchase kept on file to automatically charge

in advance of the first day of each month following your initial payment.


If your Payment Source cannot be charged for any reason,

and you have not otherwise made the appropriate monthly

payment on time, your Plan coverage will cease from the due date.

BIONIC AIM LLC has the right, but not the obligation,

to accept any late payment and allow your Plan to continue

from the date of late payment. BIONIC AIM LLC has the right

to pursue a payment, from you, to comply your full contract agreement with us.

You are liable for any amount due, over the amount covered

per repair in some service plans, as per this contract. By signing up you agree to the terms and conditions here

described.


What is Covered?


Hardware. Repairable or replaceable parts of the accessible device you own. 

Purchased from us or from another provider.


Technical support. ​During the Coverage Period, BIONIC AIM LLC will provide you with access to

telephone and web-based technical support resources. Technical support

may include assistance with troubleshooting, and repair.

The scope of technical support provided to you will vary according to your Plan.


What is not Covered?


Hardware. The Plan does not apply to:

(a) Removal or disposal of the Covered Equipment, or the provision of

equipment while the Covered Equipment is being serviced;

(b) Damage caused by accident, abuse, misuse, liquid damage, fire,

earthquake or other external cause, and or operating the Covered Equipment

outside the permitted or intended uses described by the manufacturer,

or service (including upgrades and modifications) performed by anyone who is not

a representative of BIONIC AIM LLC or Project ADROIT;

(c) Covered Equipment that has been lost or stolen.

(d) Cosmetic damage to the Covered Equipment including but not limited

to scratches, dents and broken plastic.

(e) Any additional device that is not part of the OEM equipment, which means

Accessible vehicle manufacturer or Dealer brand manufacturer.


Technical Support. The Plan does not include:

(a) Your use of or modification to the Covered Equipment

(b) Third-party products or their effects on or interactions with the Covered Equipment.


How to Obtain Service and Support?


You may obtain hardware services or repair and technical support by

calling to (408)836-3464 or emailing your request to support@bionicaim.com

If calling, a BIONIC AIM LLC technical support representative

will answer, request to use any source of video conference and 

collect information about you and the problem you are having with your device. 


Service Options

BIONIC AIM LLC will provide services through one or more of the following options:

(a) By appointment, Mobile service. We have arranged to visit your location

and provide our services right on the spot; or, go where you are when a problem occurs.

(b) By appointment Drive-in service. Bring the Equipment to a BIONIC AIM LLC

owned Service store or a network service provider authorized by BIONIC AIM LLC

location offering appointment drive-in service. Service will be performed at the location.

Once you are notified that service is complete, you will promptly retrieve your device.

(c) do-it-yourself (“DIY”) parts service (For specific Individual plans).

DIY parts service is available for many Covered Equipment parts, allowing you

to service your own product. If DIY parts service is available in the circumstances,

the following process will apply. If BIONIC AIM LLC requires return of the

replaced device or part, BIONIC AIM LLC may require a credit card authorization

to serve as security for the retail price of the replacement device or part and

applicable shipping costs until you return the replaced device as instructed.

If you are not able to provide credit card authorization, service may not

be available to you in which case BIONIC AIM LLC will offer an alternative

arrangement for service. If you fail to return the replaced device or

part as instructed or return a replaced device or part that is ineligible for

service, BIONIC AIM LLC will charge the credit card for the authorized amount.

If BIONIC AIM LLC does not require return of the replaced device or part,

BIONIC AIM LLC will ship you free of charge a replacement device or part

accompanied by any applicable instructions or requirements for disposal of

the replaced device or part. BIONIC AIM LLC is not responsible for any labor

costs you incur in respect to DIY parts service. Should you require

BIONIC AIM LLC reserves the right to change the method by which BIONIC AIM LLC

may provide repair or replacement service to you, and your Covered Equipment’s


eligibility to receive a particular method of service.

Service will be limited to the options available in the State where service is requested.

Service options, parts availability and response times may vary according to manufacturer.

BionicAIM does not offer international service coverage under any service plan.


Your Responsibilities

To receive service or support under the Plan, you agree to comply with the following:

(a) Provide your Plan ID Number and a copy of your Plan’s original proof of purchase, if requested;

(b) Provide information about the symptoms and causes of the issues with the Covered Equipment;

(c) Respond to requests for information, including but not limited to the Covered Equipment Manufacturer, model, serial number, Cycles (if applicable), actions taken before the Covered Equipment experienced the issue and steps taken to resolve the issue;

(d) Follow instructions BIONIC AIM LLC gives you.


Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIONIC AIM LLC AND ITS EMPLOYEES AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE TO YOU OR ANY SUBSEQUENT OWNER FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DATA OR THE FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA, ANY LOSS OF BUSINESS, PROFITS, REVENUE OR ANTICIPATED SAVINGS, RESULTING FROM BIONIC AIM LLC OBLIGATIONS UNDER THIS PLAN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIMIT OF BIONIC AIM LLC AND ITS EMPLOYEES AND AGENT’S LIABILITY TO YOU AND ANY SUBSEQUENT OWNER ARISING UNDER THE PLAN SHALL NOT EXCEED THE ORIGINAL PRICE PAID FOR THE PLAN THE LAST MONTH PAID. BIONIC AIM LLC SPECIFICALLY DOES NOT WARRANT THAT (i) IT WILL BE ABLE TO REPAIR OR REPLACE COVERED EQUIPMENT, OR (ii) THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.

FOR CONSUMERS IN JURISDICTIONS WHO HAVE THE BENEFIT OF CONSUMER PROTECTION LAWS OR REGULATIONS, THE BENEFITS CONFERRED BY THIS PLAN ARE IN ADDITION TO ALL RIGHTS AND REMEDIES PROVIDED UNDER SUCH LAWS AND REGULATIONS. TO THE EXTENT THAT LIABILITY UNDER SUCH LAWS AND REGULATIONS MAY BE LIMITED, BIONIC AIM LLC LIABILITY IS LIMITED, AT ITS SOLE OPTION, TO REPAIR OF THE COVERED EQUIPMENT OR SUPPLY OF THE SERVICE. SOME STATES OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.


Cancellation

Your Cancellation Rights

Regardless of your method of purchase, you may cancel this Plan 12 months

after your subscription started in order to fully comply with the agreement and to

cover any remaining balance.

Or, you must pay any or all invoices full amount due from a maintenance,

troubleshooting or repair service provided during the life of your subscription 

before you may cancel your subscription.


Monthly Pay Plans

To cancel a monthly-Pay Plan, you may call BIONIC AIM LLC, or send written notice

with your request to BIONIC AIM LLC support team, 457 Porter ln, San Jose CA. 95127.

You must send a copy of the Plan’s original proof of purchase with your notice.

Unless local law provides otherwise, cancellation refunds will be provided as follows:

(A) If you cancel within seven (7) days of your Plan’s purchase or monthly paid date,

and you have not received a confirmation service appointment, you will receive a

full refund for the last paid amount ONLY (Your service plan is based in a monthly coverage).

(B) If you cancel more than seven (7) days after your purchase or your payment,

or if you received a service or repair, you are not entitled for a refund. Your cancellation

will proceed and your coverage will end the same day you requested the termination of your contract.

Please understand this information:

For any plan you may cancel any time within the first 7 days of your subscription.

If you received any scheduled appointment date you are not eligible

for a refund. If you cancel within the first seven days and you did not receive

any tech support or have been scheduled for a visit you are eligible for a refund.

If you cancel after receiving a service or repair, and the law specifies that you

can cancel, you must pay the total amount showed on your invoice minus

the last month paid amount before you can go free.


BIONIC AIM LLC Cancellation Rights

Unless applicable local law provides otherwise, BIONIC AIM LLC may

cancel this Plan for fraud or material misrepresentation. Unless applicable local law

provides otherwise, BIONIC AIM LLC may also cancel this Plan if service

parts for the Covered Equipment are not available, upon thirty (30) days’ prior written

notice. If BIONIC AIM LLC cancels this Plan for the unavailability of service parts,

 BIONIC AIM LLC future obligations under this Plan to you are fully extinguished.


Transfer of Plan. NOT AUTHORIZED.


General

(a) BIONIC AIM LLC may subcontract or assign performance of its obligations

to third parties but shall not be relieved of its obligations to you in doing so.

(b) BIONIC AIM LLC is not responsible for any failures or delays in performing under

the Plan that are due to events outside BIONIC AIM LLC reasonable control.

(c) You are not required to perform preventative maintenance on the Covered

Equipment to receive service under the Plan.

(d) This Plan is offered and valid only if you are a resident of California or if you can

prove that an address in California belongs to a family member and You are requesting the service 

at that address. 

Persons who have not reached the age of maturity may not purchase this Plan.

 This Plan may not be available where prohibited by law.

(e) In carrying out its obligations BIONIC AIM LLC may, solely for the purposes of monitoring

the quality of BIONIC AIM LLC response, record part or all of the calls between

you and BIONIC AIM LLC.

(f) You agree that any information or data disclosed to BIONIC AIM LLC under this

Plan is not confidential or proprietary to you. Furthermore, you agree that

BIONIC AIM LLC may collect and process data on your behalf when it

provides service. This may include transferring your data to affiliated companies or

service providers located in countries where data protection laws may be less

comprehensive than your country of residence.

(g) The terms of the Plan, including the original sales receipt of the Plan and the Plan

Confirmation, prevail over any conflicting, additional, or other terms of any purchase

order or other document, and constitute your and BIONIC AIM LLC entire

understanding with respect to the Plan.

(j) There is no informal dispute settlement process available under this Plan.

(k) For Plans sold in California, “BIONIC AIM LLC” is BIONIC AIM LLC, 

with headquarters located at 457 Porter ln, San Jose CA. 95127.

(l) Except where prohibited by law, the laws of the State of California govern Plans

purchased in the United States.

(m) Support services under this Plan may be available in English and Spanish only.

(n) There is no deductible payment due in respect of a claim made under this Plan.

(o) The Plan will not be cancelled due to pre-existing conditions in the Covered Equipment

 that are eligible for service under this Plan.
