Every Bionic Shield plan comes with Full hardware repair coverage
through the life of the plan subscription. All parts warranty is extended from
the time you subscribe until the subscription is cancelled. In addition,
you’ll get 24/7 priority access to BIONIC AIM experts by chat or phone or visit.
The plan
NO contract plan.
When Coverage Begins and Ends
Coverage begins when you purchase the Plan and the same day you cancel your membership.
There is no tech support under this plan.
The plan is an extension to your manufacturer warranty and is
only protecting your investment for the life of your subscription.
Your plan is a Monthly Pay Plans, you agree to have the credit card,
debit card or other authorized payment source i.e., Visa (the “Payment Source”)
used for your Plan purchase kept on file to automatically charge
in advance of the first day of your subscription (each month) following your initial payment.
If your Payment Source cannot be charged for any reason,
and you have not otherwise made the appropriate monthly
payment on time, your Plan coverage will cease from the due date.
BIONIC AIM LLC has the right, but not the obligation,
to accept any late payment and allow your Plan to continue
from the date of late payment.
You are liable for any amount due, over the amount covered
per month, as per this agreement.
What is Covered?
Hardware. Each part you purchase from us.
Technical support. NOT COVERED.
The scope of plan support provided is to cover each individual
part you purchase from us. Ex. Purchase one part then subscribe to protect it.
Purchase any or all other parts and your subscription price will cover each of them ONLY.
What is not Covered?
Hardware.
The Plan does not apply to:
(a) Installation of the purchased or the protected part.
(b) Damage caused by accident, abuse, misuse, liquid damage, fire,
earthquake or other external cause, and or operating the Covered Equipment
outside the permitted or intended uses described by the manufacturer,
or service (including upgrades and modifications) performed by anyone who is not
a representative of BIONIC AIM LLC or Project ADROIT);
(c) Covered Equipment that has been lost or stolen.
(d) Cosmetic damage to the Covered Equipment including but not limited
to scratches, dents.

Service Options
BIONIC AIM LLC will provide services through one or more of the following options:
(a) By appointment, Mobile service. We will arrange to visit your location
and provide our services right on the spot; or go where you are when a problem occurs.
(b) By appointment Drive-in service. Bring the Equipment to a BIONIC AIM LLC
owned Service store or a network service provider authorized by BIONIC AIM LLC
location offering appointment drive-in service. Service will be performed at the location.
Once you are notified that service is complete, you will promptly retrieve your device.
Service will be limited to the options available in the country where service is requested.
Service options, parts availability and response times may vary according to country.
If you seek service in a country that is not the country of purchase, you will comply with
all applicable import and export laws and regulations and be responsible for all custom duties,
V.A.T. and other associated taxes and charges. For international service, BIONIC AIM LLC
may repair a failing device and parts with comparable products and parts that comply with
local standards.
Your Responsibilities
To receive service or support under the Plan, you agree to comply with the following:
(a) Provide your Plan ID Number and a copy of your Plan’s original proof of purchase, if requested.
(b) Provide information about the symptoms and causes of the issues with the Covered Equipment.
(c) Respond to requests for information, including but not limited to the Covered Equipment Manufacturer, model, serial number, Cycles (if applicable), actions taken before the Covered Equipment experienced the issue and steps taken to resolve the issue.
(d) Follow instructions BIONIC AIM LLC gives you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIONIC AIM LLC AND ITS EMPLOYEES AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE TO YOU OR ANY SUBSEQUENT OWNER FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DATA OR THE FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA, ANY LOSS OF BUSINESS, PROFITS, REVENUE OR ANTICIPATED SAVINGS, RESULTING FROM BIONIC AIM LLC OBLIGATIONS UNDER THIS PLAN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIMIT OF BIONIC AIM LLC AND ITS EMPLOYEES AND AGENT’S LIABILITY TO YOU AND ANY SUBSEQUENT OWNER ARISING UNDER THE PLAN SHALL NOT EXCEED THE ORIGINAL PRICE PAID FOR THE PLAN THE LAST MONTH PAID. BIONIC AIM LLC SPECIFICALLY DOES NOT WARRANT THAT (i) IT WILL BE ABLE TO REPAIR OR REPLACE COVERED EQUIPMENT, OR (ii) THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.
FOR CONSUMERS IN JURISDICTIONS WHO HAVE THE BENEFIT OF CONSUMER PROTECTION LAWS OR REGULATIONS, THE BENEFITS CONFERRED BY THIS PLAN ARE IN ADDITION TO ALL RIGHTS AND REMEDIES PROVIDED UNDER SUCH LAWS AND REGULATIONS. TO THE EXTENT THAT LIABILITY UNDER SUCH LAWS AND REGULATIONS MAY BE LIMITED, BIONIC AIM LLC LIABILITY IS LIMITED, AT ITS SOLE OPTION, TO REPAIR OF THE COVERED EQUIPMENT OR SUPPLY OF THE SERVICE. SOME STATES OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Cancellation
Your Cancellation Rights
Regardless of your method of purchase, you may cancel this Plan at any time
after your subscription started.
By cancelling your service plan you agree to pay any or all invoices full amount due from a maintenance,
troubleshooting or repair service provided during the life of your subscription before you may cancel your subscription.
Monthly Pay Plans
To cancel a monthly-Pay Plan, you may call BIONIC AIM LLC, or send an electronic request of cancellation letter to BIONIC AIM LLC support team via email support@bionicaim.com.
Unless local law provides otherwise, cancellation refunds will be provided as follows:
(A) There is no refund.
Unless applicable local law provides otherwise, BIONIC AIM LLC may
cancel this Plan for fraud or material misrepresentation. Unless applicable local law
provides otherwise, BIONIC AIM LLC may also cancel this Plan if service
parts for the Covered Equipment are not available, upon thirty (30) days’ prior written
notice.
Transfer of Plan. NOT APPLICABLE.
General
(a) BIONIC AIM LLC may subcontract or assign performance of its obligations
to third parties but shall not be relieved of its obligations to you in doing so.
(b) BIONIC AIM LLC is not responsible for any failures or delays in performing under
the Plans that are due to events outside BIONIC AIM LLC reasonable control.
(c) You are not required to perform preventative maintenance on the Covered
Equipment to receive service under the Plan.
(d) This Plan is offered and valid only if you are a resident of California or if you can
prove that an address in California belongs to a family member and You are
present that address by the time of your service appointment. Persons who have not
reached the age of majority may not purchase this Plan. This Plan may not be
available where prohibited by law.
(e) In carrying out its obligations BIONIC AIM LLC may, solely for the purposes of monitoring
the quality of BIONIC AIM LLC response, record part or all of the calls between
you and BIONIC AIM LLC.
(f) You agree that any information or data disclosed to BIONIC AIM LLC under this
Plan is not confidential or proprietary to you. Furthermore, you agree that
BIONIC AIM LLC may collect and process data on your behalf when it
provides service. This may include transferring your data to affiliated companies or
service providers located in countries where data protection laws may be less
comprehensive than your country of residence, including but not limited to Australia,
Canada, countries of the European Union, India, Japan, the People’s Republic of China and the U.S.
(g) BIONIC AIM LLC has security measures, which should protect your data against
unauthorized access or disclosure as well as unlawful destruction. You will be
responsible for the instructions you give to BIONIC AIM LLC regarding the processing
of data, and BIONIC AIM LLC will seek to comply with those instructions as reasonably
necessary for the performance of the service and support obligations under the Plan.
If you do not agree with the above or if you have questions regarding how your data
may be impacted by being processed in this way, contact BIONIC AIM LLC

(h) BIONIC AIM LLC will protect your information in accordance with BIONIC AIM LLC
Customer Privacy Policy available at URL www.mobilityet.com/privacy
(i) The terms of the Plan, including the original sales receipt of the Plan and the Plan
Confirmation, prevail over any conflicting, additional, or other terms of any purchase
order or other document, and constitute your and BIONIC AIM LLC entire
understanding with respect to the Plan.
(j) There is no informal dispute settlement process available under this Plan.
(k) For Plans sold in California, “BIONIC AIM LLC” is BIONIC AIM LLC, 457 Porter ln, San Jose CA. 95127.
(l) Except where prohibited by law, the laws of the State of California govern Plans
purchased in the United States.
(m) Support services under this Plan may be available in English and Spanish only.
(n) There is no deductible payment due in respect of a claim made under this Plan.
(o) The Plan will not be cancelled due to pre-existing conditions in the Covered Equipment that are eligible for service under this Plan.
